Member of the Legislative Council (MLC)Byrathi Suresh too has joined the league of building byelaw violators with major violations at his upcoming plush office on Cunningham Road.
Documents available with DH show that Suresh, an Independent MLC who is an associate member of the ruling Congress party, is constructing a building on a plot measuring 3,560 sqft on Cunningham Road.
The Town Planning section of the Bruhat Bengaluru Mahanagara Palike (BBMP) sanctioned the building plan on September 30, 2015 permitting him to construct a basement, ground floor and three upper floors.
However, Suresh, cousin of KRPuram Congress MLAByrathi Basavaraj, went on to construct two extra floors. While one has already been constructed the other is underway. He has even violated the setback norms. Since setbacks have not been left for ventilation, the building will have to depend on electricity round-the-clock.
A local resident P G Belliappa was alarmed when he saw the building coming up next to his house in gross violation of building laws. He filed an RTI application with the BBMP seeking information on the building plan and other details of the building on February 18, 2016. However, officers were not keen on providing information. They went on transferring the application from one officer to another, only to delay the process.
"RTI did not help me get the information. I chanced upon the sanctioned plan and other documents through some other sources. After going through the documents, I realised the violations," said Belliappa. Based on the documents, he lodged a complaint with the BBMP commissioner N Manjunatha Prasad on November 9. However no action has been taken so far.
When contacted by DH, Suresh conceded that he has constructed 'one extra floor' in violation of the building plan. "It is wrong to say that two extra floors than those permitted in the sanctioned plan have been constructed. I have built a small house with two rooms on the top of the building. I have asked my workers to raze them," said the MLC.
He rejected the claim that no setback has been left. "Anybody can come and check. We have left setbacks as per the sanctioned plan. There are no violations other than the small extra floor next to the lift," he maintained.
