Centre: Cauvery Board part of legislative exercise

The Centre on Monday cited before the Supreme Court instances of Bhakra-Beas and Krishna-Godavari Management Boards to contend that setting up of the Cauvery Management Board is part of a legislative exercise.

With a plea to recall its earlier order on constituting the Cauvery Management Board (CMB), the Centre said, "Bhakra-Beas Management Board was set up under the Punjab Reorganisation Act while the Krishna River Management and Godavari River Management Boards have been set up under the AP Reorganisation Act, 2014. In fact, the Ravi and Beas Waters Tribunal has been set up by virtue of Section 14 of the 1956 Act."

Attorney General Mukul Rohatgi, who mentioned the Centres application before a bench headed by Justice Dipak Misra, brought to the notice of the bench that it should not have asked it to set up the CMB as the main civil appeal on the issue was still pending and it was not a party before the Cauvery Water Disputes Tribunal which had sought the establishment of the CMB.

"Constitution of a board as suggested by the tribunal and ordered by the court on September 20 is not contemplated by the statute," the Centre said in its application.
