HC notice to BBMP chief over malls on drain, park

Karnataka High Court on Wednesday issued emergent notice to Bruhat Bengaluru Mahanagara Palike (BBMP) commissioner in a contempt petition filed by a cultural and social organisation, Samarpana.

The division bench of Justice S Abdul Nazeer and Justice K S Mudagal ordered the issuance of notice to BBMP commissioner N Manjunath Prasad. The High Court division bench had observed on August 29, 2016 that the construction of two malls and a star hotel on a stormwater drain and a park required comprehensive investigation.

The bench had directed the petitioner (PIL) to submit a representation before the BBMP commissioner by a fortnight so that the latter can dispose of the case within three months of the date of receiving the representation. The BBMP commissioner has failed to comply with the directions, advocate representing the petitioner G R Mohan contended.

According to the petition, Orion Mall, built by Brigade Enterprises, is constructed on a stormwater drain and 'B' kharab land in Yeshwantpur, while ETA Mall is built on a park land at Binnypet.

The petition also contended that JW Marriott Hotel near UB City is also constructed on a stormwater drain. The petitioner stated that the BBMP has been demolishing only a few select buildings on stormwater drains and park lands. The BBMP has the authority to clear encroachments on rajakaluves/storm water drains under Section 228-D of the Karnataka Municipal Corporation Act.
