BDA site application fee may be refunded with interest

The state government is mulling over amendments to the Bangalore Development Authority (BDA) Act to refund the application fees with interest, in case the BDA is not able to allot sites to applicants, Bengaluru Development Minister K J George told the Legislative Council on Thursday.

He was replying to a question by D S Veeraiah (BJP), who said that the BDA has been collecting thousands of rupees as application fees, promising allotment of sites. But it has not alloted sites even after 10 years, in several instances. Collecting the fees and not allotting sites is unacceptable, he added.

"The BDA earns interest on the money collected as fees. Hence, the fee and interest amount should be returned to the applicants," Veeraiah said.

George said that the BDA Act will have to be modified if the application fees has to be returned with interest. At present, there is no provision to pay interset while returning the fees, he pointed out.

He said that the BDA had collected an initial deposit of Rs 543.69 crore from 26,349 applicants who had applied for sites in Kempegowda Layout. As many as 19,385 applicants could not get the sites, and their fee amount would be returned, he added.

Alternative sites

George said that applications of 2,562 land owners who had applied for alternative sites for having lost their revenue sites to layouts developed by the BDA were still pending.

Replying to R Chowdareddy Thoopalli (JD-S), the minister said that BDA had received 5,251 applications from those who had lost their revenue sites for the development of Sir M Visvesvaraya Layout, Sir M Visvesvaraya Extended layout and Banashankari 6th stage Extended layout. Of these, the BDA had provided alternative sites to 2,501 applicants. As per the court direction, applicants are required to register only to get alternative sites.

Reddy said that as the BDA had published a notification in newspapers for availing of alternative sites, several illiterates in villages are unaware of the same. As a result, thousands of people are being deprived of their rights. George however said that there are only one or two such cases.

To another question raised by BJP member Ramachandra Gowda in connection with Arkavathy Layout, George said that 8,730 sites of various sizes were distributed in 2005. Of these, 5,760 sites had been registered in the names of the beneficiaries, while 2,970 are yet to be registered.

The pendency of cases in various courts in connection with the acquisition of 341 acres had delayed the registration process.
